The Employment Equity Act Amendments are scheduled to take effect on January 1, 2025.

The amendments will introduce various changes including two more important changes being:

· Sectoral numerical targets

The Minister of Employment and Labour will be able to set targets for economic sectors to ensure that historically disadvantaged groups are represented equitably in the workforce.

· Reduced application for some sections

Certain sections of the Employment Equity Act will only apply to a smaller group of employers, which will reduce the administrative burden on smaller businesses.

The amendments also include:

· Removing the requirement for psychological testing and similar assessments to be certified by the Health Professions Council of South Africa

· Providing for a certificate from the minister confirming an employer’s compliance with the act

The Department of Employment and Labour (DEL) issued draft regulations for comment in February 2024. The draft regulations include:

· Setting annual numerical targets for upper and lower occupational levels

· Clarifying that the National EAP applies to designated employers that operate nationally
